GENERAL PART
General provisions

1.1. “Vichy” Aqua Park (hereinafter – Aqua Park) is leisure and entertainment complex at Ozo St. 14C, Vilnius, which consists of bathhouse zone, swimming pool, water slide zone and other water amusements.

1.2.  Aqua Park operator (hereinafter - Operator) is JSC “Vandens parkas” (reg. Address: Ozo St. 14, Vilnius , company code: 300023589, VAT payer code: LT100001025317, registrar: SC “Registrų centras”, Vilnius branch).

1.3.  Visitor is any person present in the Aqua Park. Each person, who has obtained a ticket or permit or has accessed the Aqua Park in any other way set by Operator, is considered visitor.

1.4.  Rules determinate the Aqua Park visitor service (service provision) order, obligatory safety, hygiene and other requirements for visitors, Operator and visitors rights, duties and limits of their liability. These Aqua Park rules have been made with the aim to ensure enjoyable relaxation and good humour for each visitor of the Aqua Park and escape unpleasant misunderstandings, traumas or other losses;

1.5.  Rules are applicable for all visitors. Each visitor must observe requirements of the rules.

1.6.  A visitor gains right to use the Aqua Park services only if he/she obtains a ticket or permit or accesses the Aqua Park in any other way set by Operator. Ticket purchase and other related conditions are set here too.

1.7.  Each visitor, who accesses the Aqua Park, automatically claims he/she has read the Aqua Park rules and undertakes to observe their requirements unreservedly.

 

Right to use the Aqua Park services

1.8. Visitors of any age group of at least 1.30 m (one metre and thirty centimetres) of height shall have the right to use the services provided by the Aqua Park, with regard to the exceptions stipulated by these rules.

1.9.  Visitors who comply with the height requirement specified in Clause 1.8 of the Rules, but who are under 14 years of age and who visit the Aqua Park alone, i.e. not accompanied by adult persons, shall:

1.9.1.  upon the instruction of the personnel of the Aqua Park (when the personnel of the Aqua Park considers it to be necessary), wear life preservers in the Aqua Park (life-jackets, arm band floaties, etc.). Visitors may bring life preservers specified in this sub clause to the Aqua Park or rent or purchase them for the fixed price in the Aqua Park;

1.9.2.  submit a consent of the form established by the Aqua Park signed by parents or foster parents to the personnel of the Aqua Park every time they visit the Aqua Park. The consent is valid for only one visit in the Aqua Park, i.e. a new consent by parents or foster parents shall be presented upon every visit to the Aqua Park. The form of consent may be obtained at the Aqua Park or at http://www.vandensparkas.lt.

1.9.3. comply with the requirements of using water amusements and observe these Rules. Visitors specified in this clause of the Rules shall have the right to use not all amusements of the Aqua Park. Information about limitations of using the amusements is indicated at every amusement, and the lifeguard shall have the right to communicate such information.

1.10.  Children under 7 years of age and persons with disabilities shall have the right to visit the Aqua Park only accompanied by adult persons who, together with persons under their supervision, shall be responsible for compliance with these Rules.

Ticket price and purchase order

1.11. Ticket price shall be set by Operator. Ticket prices shall be announced in the Aqua Park cash-desks and websites enumerated below.

1.12.  Visitors can obtain tickets at the Aqua Park cash-desks or the following websites: http://www.vandensparkas.lt/, http://www.tiketa.lt, http://www.geradovana.lt/.

1.13.  Before obtaining advance tickets to the Aqua Park on the internet or purchasing them at the Aqua Park cash-desks, visitors must claim their benevolent cooperation and willingness to observe these Rules. Only in such case they will be able to obtain tickets.

1.14.  Tickets may not be marketed on temporary basis:

1.14.1.  due to technical faults;

1.14.2. when all individual bathing-boxes are busy;

1.14.3.  in other cases.

1.15.  Due to technical faults, the Aqua Park may temporarily forbid using particular services such as jacuzzi, water slides, wave pool, bathhouses, etc. In above-mentioned cases ticket price shall not be recalculated or reimbursed to visitors.

1.16.  Visitors under 3 years of age shall be admitted for free.

1.17.  Operator is entitled to request visitors, who intend to purchase preference tickets, to submit age-proofing identification or other document, which can prove visitor status (disability certificate, student certificate or the like).

1.18.  In case of doubts about visitor age, the Aqua Park cashier is entitled to request submitting personal identification (passport, learner / student certificate or the like).

 

Electronic bracelet, its purpose and usage

1.19.  With respect to visitor's age and other criteria set by the rules, the Aqua Park cashiers shall give each visitor, who has obtained a ticket or permit, an individual electronic bracelet (except persons under 3, who shall not be given such bracelet):

1.19.1. Visitors from 7 to 14 years of age who comply with the requirements set forth in Clause 1.9 and its sub clauses and who visit the Aqua Park alone, i.e. without supervision of adult persons, shall be given motley electronic bracelets. These visitors shall be granted a credit of 70 Litas. This amount may be used to pay for services in the Aqua Park. Alcoholic drinks and tobacco products shall not be sold to visitors less than 18 years of age.

1.19.2. Visitors from 15 to 18 years of age and visitors from 7 to 14 years of age who visit the Aqua Park accompanied by adult persons shall be given red electronic bracelets. These visitors shall be granted a credit of 70 Litas. This amount may be used to pay for services in the Aqua Park. Alcoholic drinks and tobacco products shall not be sold to visitors less than 18 years of age.

1.19.3. Visitors over 18 years of age shall be given blue or green electronic bracelets. These visitors shall be granted a credit of 200 Litas. This amount may be used to pay for goods and services in the Aqua Park.
1.20. Upon termination of credit (i.e. a visitor uses his/her credit to the full), all visitors of the Aqua Park must pay their credit account in cash or by card. After a visitor fully pays his/her credit account in the room of the administrator of personal lockers, a visitor may, upon his/her request, be granted a new credit.

1.21. The Aqua Park visitors, who have their bracelets, must pass entrance gate one by one and put their bracelets to scanner mounted near entrance gate.

1.22. In case if one fails to put his / her bracelet to the marked place, the gate shall not open to let him/her in the Aqua Park and electronic bracelet shall not be activated for using the Aqua Park services and settling for such services and/or goods purchased inside.

1.23. Persons without electronic bracelet shall not be admitted to the Aqua Park, except persons under 3 years of age.

1.24. Visitor's electronic bracelet allows unlocking and locking individual left-stuff cabin in bathing-box. Information terminals can provide visitors with information on time spent inside the Aqua Park, number of individual left-stuff cabin and credit remainder.

1.25. Visitor timer inside the Aqua Park shall be switched on from the moment of passing entrance gate or automatically in 30 minutes after a cashier has given the bracelet. Electronic bracelet expires after purchased ticket time is out.

1.26. Leaving the Aqua Park each visitor must sign out at exit cash-desk. By doing this exact time visitor has spent inside the Aqua Park is indicated (however, the time is not stopped at the cash-desk) also payable amounts for the Aqua Park services and/or obtained goods are calculated. The time spent by a visitor in the Aqua Park shall be stopped after a visitor puts the bracelet into a special collector and passes through the exit gate.

1.27. Additional time spent in the Aqua Park (the time, which has not been settled for by obtaining electronic bracelet) or lag (the time, which has passed after the Aqua Park business hours) shall be automatically applied additional payment under the Aqua Park pricelist and visitors must make such payment at exit cash-desk.

1.28. Visitors cannot leave the Aqua Park territory without signing out routinely, i.e. after a visitor pays, puts the bracelet into a special collector and passes through the exit gate.

1.29. In case a visitor wishes to access the Aqua Park territory repeatedly, he/she must obtain a new ticket.

1.30. Point 1.28 provisions shall not be applied, if a visitor is forced to leave the Aqua Park through specific exit (e.g., in case of evacuation). In such cases electronic bracelets must be consigned to accompanying personnel or chief cashier.

1.31. In case a visitor leaves the Aqua Park beforehand, i.e., he/she fail to stay inside for the whole time purchased, money shall not be reimbursed.

1.32. A visitor can use his/her electronic bracelet for settlement in bars, restaurants or for any other Aqua Park services. He/she must cover all credit amount spent at exit cash-desk.

1.33. In case a visitor fails to settle for additional time spent inside the Aqua Park and/or services provided, the amount due shall be recovered under determinate order of laws of the Republic of Lithuania.

1.34. If visitors are uncertain about the procedure of using the electronic bracelet, they can address any cashier of the Aqua Park or administrator of personal lockers.

Other general information

1.35. Under safety considerations the Aqua Park has mounted shooting system. Thus, it automatically takes a photo of each visitor passing the entrance gate.

1.36. Having passed the entrance gate visitors must put their outerwear and shoes in specific bags and leave them in locker-room foyer.

1.37. Each visitor must have his/her own swimming costume.

1.38. Visitors may bring their own towels or rent them in the room of the administrator of personal lockers of the Aqua Park or the bar “Švyturys” in the bath zone.

1.39. While in the Aqua Park, visitors shall wear slippers suitable for humid environment. Visitors who do not have such slippers may buy them in the “Honolulu Market” in the lobby.

1.40. Towels and bathrobes may be rented in the Aqua Park. In such case, information on the provision of such services shall be entered in the electronic bracelet. Rented towels and bathrobes shall be returned to the rent point in the room of the administrator of personal lockers after use, where this information shall be entered in the electronic bracelet. If the rented items are not returned, visitors shall pay the full price of the item (as if buying the item) at the cash desk at the exit.

1.41. While in the Aqua Park, visitors shall leave their personal belongings in the cloakroom and in personal lockers. Locking of the lockers is the responsibility of visitors; therefore the administration of the Aqua Park recommends that visitors make sure their lockers are secure.

1.42. Bathing-box user instructions are given in places of change.

1.43. The Aqua Park locker-rooms have paid safes. Information on safe usage can be provided by the Aqua Park locker-room personnel.

1.44. In case of disappearance of personal things we insist you addressing any Aqua Park administration member immediately.

1.45. Things lost by visitors in the Aqua Park and later found by other visitors or the Aqua Park personnel shall be either stored in the Aqua Park or transferred to the police under legal acts of the Republic of Lithuania at operator's discretion.

1.46. Visitors are allowed to change clothes only in specifically designed cabins.

1.47. Following hygiene requirements, all visitors entering water zones of the Aqua Park are requested to take a shower and use soap.

1.48. Visitors must leave water zones of the Aqua Park minimum 20 minutes before the Aqua Park closing hours.

1.49. Visitors must leave water zones of the Aqua Park immediately , if a lifeguard requires doing so.

 

 

2.  VISITORS RIGHTS AND LIABILITIES

2.1. Visitors are entitled to:

 2.1.1. Request the Aqua Park authorized person to be introduced with the rules before visitors start using services of the Aqua Park.

 2.1.2. Use of the Aqua Park services only having made a payment for selected time in the park or having obtained a right to use the Aqua Park services in any other way set by Operator.

 2.1.3.  Request compensation for loss they have suffered under these rules and legal acts of the Republic of Lithuania.

2.2. Visitors undertake to:

2.2.1. strictly observe requirements and recommendations of the rules, when being in the Aqua Park and using its services.

2.2.2.  wear and use the electronic bracelet specially attached to him/her, when being in the Aqua Park and using its services.

2.2.3. obey the instructions of the operator's representatives concerning safety requirements and compliance with these rules in the Aqua Park.

 

3.  OPERATOR RIGHTS AND LIABILITIES

3.1.  Operator is entitled to:

3.1.1. Block the Aqua Park admittance to persons, whose behaviour may discomfit the Aqua Park order, is dangerous to safety of visitors and hygiene situation in the Aqua Park and/or be in conflict with behaviour norms acceptable by society.

3.1.2.  Block the Aqua Park admittance to persons, who object or do not understand following the Rules.

3.1.3.  Change the Aqua Park service range and/or service tariffs at any time without prior notice.

3.1.4.  Eliminate visitors from the Aqua Park, if they continue violating the Aqua Park Rules after being warned. In such cases money shall not be reimbursed to such visitors.

3.2.  Operator undertakes to:

3.2.1. Provide visitors with the Aqua Park services following applicable requirements of legal acts of the Republic of Lithuania.

 

4.  RECOMMENDATIONS TO VISITORS

4.1.  The Aqua Park administration recommends would-be visitors of the Aqua Park to ascertain that their health condition allows them using the Aqua Park services and have a full-rate time here.

4.2. With respect to variety of the Aqua Park amusements and physical or psychological condition of particular visitors, particular amusements may not be recommended.

4.3. Visitors, who wear any type of glasses, are recommended to use the Aqua Park services only having tied their glasses with specific bands.

4.4.  Visitors are insistently recommended not to bring expensive and valuable things (jewellery, chainlets, rings, watches, cell phones and the like), which may be lost or spoiled because of humidity, to the Aqua Park.

4.5.  It is forbidden for visitors to use any of the Aqua Park services wearing any type of jewellery.

4.6. Recommendations related to provision of particular services are given in other sections of the rules.

 


5.  GENERAL RULES OF SAFE BEHAVIOUR

The Aqua Park strictly forbids:

5.1. Shouting, whistling, misleading lifeguards by unreasonable cries for help, running (a visitor may slip and hurt him/herself) and hustling;

5.2. Using the Aqua Park services wearing improper clothes (e.g., underwear) or being undressed;

5.3.  Spitting on the floors and into the water, satisfying biological needs beyond lavatories;

5.4.  Climbing amusements, handrails, decorations or otherwise destroying the Aqua Park inventor;

5.5. Sliding handrails and climbing steel constructions;

5.6.  Leaving children under 14 unattended by an adult with reservation of the cases, when these children satisfy the height requirement stipulated by 1.8. Clause of the Rules and when the Aqua Park has received the signed consent form determinated by 1.9.2 sub clause of the Rules.

5.7.  Underage persons under 18 using and buying alcohol;

5.8.  Bringing food or drink and glass and sharp things to the Aqua Park;

5.9.  Smoking;

5.10. Taking photos;

5.11.  Shooting;

5.12.  Wearing outdoor footwear, unless in foyer;

5.13.  Wearing footwear in water (excluding specific purpose footwear);

5.14.  Pushing, behaving rude, disturbing other visitors to use the Aqua Park services;

5.15.  The Aqua Park access is strictly denied to:

5.15.1.  Persons ill with infectious, viral or other communicable diseases; persons with open lesions and/or other health disorders, which may be harmful to health and/or life of themselves or other visitors;

5.15.2.  Persons inebriate of alcohol, drugs or psychotropic materials. The Aqua Park personnel (lifeguard service) is entitled to request taking alcohol test (maximum allowable norm is 0,5 permille) and see inebriate visitors off the Aqua Park premises without reimbursing their entrance fee;

5.15.3.  Persons with pets;

5.16. With regard to visitors' state of health, persons with poor health (heart diseases, head traumas, etc.) shall not use extreme water slides and baths (e.g. “Draught in Hawaii”) of the Aqua Park because this may result in negative consequences.

 

6. SWIMMING POOL AND WATER SLIDE ZONE RESTRICTIONS

Swimming pool restrictions:

6.1.  It is forbidden to bring lifebuoys unsuited for particular slides or amusements;

6.2. It is forbidden to bring own amusement inventor (balls, toys, etc.);

6.3. It is forbidden for children under 6 to swim in open swimming pool without fins (hand lifebuoys) or life-jackets;

6.4.  It is forbidden to jump into swimming pool from its edge, run along swimming pool edge and swim in forbidden places;

6.5.  It is forbidden to dive into swimming pool;

6.6.  It is forbidden to get into and out of swimming pools and jacuzzis in unspecified places;

6.7.  It is forbidden for children under 3 to swim in swimming pool without specific diapers designed for usage in water;

6.8. It is forbidden to violate instructions and rules for slide and other amusement use method and order. In case of uncertainty one should address lifeguards.

 

Water slide zone restrictions:

6.9.  It is forbidden to use water slides for visitors who fail to comply with requirements of those particular slides.

6.10. It is forbidden to use water slides with additional devices, unless they are specific lifebuoys.

6.11.  It is forbidden to enter water slide opening at red light or when the Aqua Park personnel (lifeguards) forbid doing so;

6.12. It is forbidden to create situations, which could harm other visitors of the Aqua Park.

6.13.  It is forbidden to run up and jump into water slide opening to increase sliding speed.

6.14.  It is forbidden to slide in groups;

6.15. It is forbidden to slide in other positions than indicated by particular water slide information and rules;

6.16.  It is forbidden to use water slides for people inebriate of alcohol, drugs or psychotropic materials;

6.17.  It is forbidden to use water slides for people with plastered or bandaged extremities;

6.18.  It is forbidden to use water slides, when personnel (lifeguards) forbids doing so;

6.19.  It is forbidden to use water slides, when their operation is stopped due to technical reasons;

6.20.  It is forbidden to wear watches, earrings, chain lets or other jewellery, which could harm visitors and/or the Aqua Park inventory;

6.21. It is forbidden to use dormant amusements;

6.22.  It is forbidden for pregnant women to use water slides;

6.23.  It is forbidden for visitors, who cannot swim, to use amusement “Rapa Nui bedugnė” (“ Rapa Nui trench”), depth of which is 3 meters and 60 centimetres;

6.24.  Having slid a water slide, one must immediately leave landing pool;

6.25.  Visitors undertake to use all amusements following rules of each particular amusement;

6.26. The Aqua Park visitors must observe particular rules and references given at the beginning of each water slide.

 

7. BATHHOUSE ZONE BEHAVIOUR RULES

7.1.  Visitors are requested to keep still in bathhouse zone.

7.2.  Bathhouse zone visitors must have a towel. Not having a towel, it is possible to rent it at the third floor in the bar.

7.3.  Before entering swimming pools, jacuzzis, bathhouses and after using bathhouses and lavatories, one must take a shower.

7.4. Visitors must enter sauna only with a big towel, which must be underlain on wooden plank-beds under the whole body.

7.5. Visitors must leave their slippers near the entrance to each sauna.

7.6.  Visitors must lay their towels on relaxation zone chair-beds and plank-beds under the whole body.

7.7.  It is not recommended to wear jewellery in bathhouse zone.

7.8.  It is not allowed to preoccupy seats in bathhouses.

7.9.  In bathhouses it is forbidden to:

7.9.1.  Bring and use own infusions, extracts and lambastes.

7.9.2.  Pour water on stones by themselves.

7.9.3.  Use cosmetics.

7.9.4. Rectify bathhouse apparatus.

 

8. LIABILITY

8.1.  Visitors, who cause damage to the Aqua Park itself, its inventory and assets and/or health of other visitors, shall be liable against laws of the Republic of Lithuania. Liability for damage caused by underage visitors, disabled shall be transferred to their parents or guardians.

8.2. Parents, guardians or other accompanying persons of underage visitors shall be liable for introducing the Aqua Park Rules to minors or disabled and for their observation of such Rules.

8.3. Visitors using electronic bracelets of other categories or those that are not theirs must pay a fine of 150 Litas.

8.4.  If the duration of a stay in the Aqua Park, the amount of credit used or other identifying data (locker number, photo, etc.) of a visitor over 17 years of age, who has lost the electronic bracelet, are known, he/she shall pay a fine of 50 Litas for the lost bracelet to the operator upon leaving and pay for the goods and services acquired in the Aqua Park. If a visitor over 17 years of age, who has lost the electronic bracelet, cannot be identified according to the above evidence, he/she shall pay a fine of 200 Litas. If the duration of a stay in the Aqua Park, the amount of credit used or other identifying data (locker number, photo, etc.) of a visitor of 3-6 and 7–17 years of age, who has lost the electronic bracelet, are known, he/she shall pay a fine of 30 Litas for the lost bracelet to the operator upon leaving and pay for the goods and services acquired in the Aqua Park. If a visitor of 3-6 and 7–17 years of age, who has lost the electronic bracelet, cannot be identified according to the above evidence, he/she shall pay a fine of 90 Litas. A fine for the lost cloakroom check shall be 15 Litas. A fine for the damaged or unreturned towel shall be 50 Litas, for a dressing-gown shall be 100 Litas.

8.5.  Having suffered property and/or non-property damage a visitor must immediately inform any Aqua Park employee and indicate place, time and circumstances of the incident. If a visitor fails to comply with this provision, overdue complaints shall not be processed.

8.6.  In case a visitor suffers property and/or non-property damage through Operator's fault, the latter shall be liable against laws of the Republic of Lithuania .

8.7. Operator shall not process visitor's claims and be liable for property and/or non-property damage suffered by a visitor, unless such visitor has followed requirements and/or recommendations of these rules.

8.8.  The operator shall bear no responsibility for the visitors' personal belongings or for loss of and/or damage to the said, including visitors' bathing suits which have been damaged while using the water slides.
